MAXIMUS INC.
Maximus Inc., which operates call centers in Athens, Midland and Austin, Texas, has been charged with failing to pay overtime rates to employees working in excess of 40 hours per week.
The class action lawsuit was filed at the US District Court in the Eastern District of Texas on behalf of current and former maintenance mechanic employees. Plaintiffs Norah Johnson and Jennifer Beeton are former employees of Maximus at the Athens, Texas call center where they were scheduled to work various hourly shifts and were hourly wage earners, i.e. paid by the hour.
Employees were not paid for work activities that included booting-up computers, initializing several software programs, performing customer call backs and reading mandatory e-mails from the company.
According to the FLSA, employees are entitled to compensation for all hours and time actually worked and they are entitled to wages at a rate of not less than their regular rate of pay up to 40 hours per week and one and one-half times their regular rate of pay for hours in excess of 40 hours in any week.
